Civil law ka ek silent killer hai – limitation period. Aapka case strong ho sakta hai, documents perfect ho sakte hain, lekin agar aap time bar ke baad suit file karte ho, to court seedha keh sakti hai: “Too late.”
Har type ka claim ka apna time frame hota hai – money recovery, specific performance, property suit, execution of decree, etc. Limitation calculation me important hota hai:
- Cause of action kab arise hua,
- Koi acknowledgement of debt / part payment hua ya nahi,
- Koi stay orders ya legal disability thi ya nahi.
Log aksar negotiation, family pressure, ya hope me years nikal dete hain. Jab tak unko legal step lene ka mann hota hai, limitation khatam ho chuki hoti hai. Phir advocate ka best argument bhi weak ho jata hai.
Extension ke kuch limited grounds hote hain – fraud, concealment, minority, etc. Lekin general “busy tha”, “pandemic ke baad dekhenge”, “rishtedaar mana kar rahe the” jaise reasons usually enough nahi hote.
Simple rule: jab substantial dispute ho, tab hi se dates note karo aur limitation check kara lo. Law unko help karta hai jo timely awake rehte hain, jo soye rehte hain unko nahi.
